Terms & Conditions

General

• The website avi-cassouto.com (the "Site") is operated by Avi Cassouto, a visual artist whose studio is located at 19 David P. Marz St., Ramat Sharet, Jerusalem (the "Artist").
• These terms apply to every artwork purchase, commission and workshop or lesson registration, whether made through the Site, by phone, by email, on WhatsApp or at the studio.
• The Terms of Use and the Privacy Policy form an integral part of these terms.
• If these terms conflict with other information on the Site, these terms prevail, subject to any mandatory provisions of law.

These terms apply equally to all genders.

The Artworks on the Site

• Every artwork offered for sale is an original work signed by the Artist. Unless stated otherwise, each work is unique and is not a print.
• The photographs on the Site were taken with care, but colors may look slightly different on different screens. Dimensions are given in centimeters and may vary slightly.
• The artworks are also shown at the studio and in other galleries, so a work may be sold before the Site is updated. The availability of each work is confirmed in a personal conversation before the deal is closed.
• You are welcome to see any artwork in person at the studio, by appointment.

Purchase and Payment

• The Site has no shopping cart and no online payment. To buy an artwork, contact Avi through the contact form, by phone, by email or on WhatsApp. Avi confirms availability, price and delivery, and the deal is then confirmed in writing, by email or WhatsApp.
• Prices on the Site are in Israeli shekels and include VAT. Buyers outside Israel can receive a price in US dollars by personal arrangement.
• Payment is made directly to Avi, by bank transfer or another agreed payment method. A receipt is issued for every payment.
• The artwork is delivered once full payment has been received, unless agreed otherwise in writing.

Prices may change. The binding price is the one agreed when the deal is closed. If a price or other detail was shown on the Site by obvious mistake, such as a typo, the Artist may cancel the deal and refund the full amount paid.

Shipping, Pickup and Packing

• You can collect the artwork from the studio in Jerusalem by appointment, or have it shipped anywhere in Israel or abroad.
• Every artwork is professionally packed and shipped fully insured. The shipping cost and estimated delivery time are agreed before payment.
• For international shipments, customs duties, taxes and import fees in the destination country are paid by the buyer, unless agreed otherwise.
• When the artwork arrives, please check the packaging and the work. If anything was damaged in transit, take photos and let Avi know within 48 hours, and he will help you handle the claim with the carrier and the insurer.

Certificate of Authenticity and Care

Every artwork is sold with a certificate of authenticity signed by the Artist. To keep the work in good condition for years, hang it away from direct sunlight, humidity and heat sources, and clean it only with a soft, dry cloth.

Cancellation and Returns

An artwork purchase made remotely, without meeting in person, is a distance sale. It is governed by the Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010:

• When you can cancel: within 14 days of receiving the artwork or the transaction details document, whichever is later.
• Senior citizens (65+), people with disabilities and new immigrants (up to 5 years from arrival) may cancel within 4 months, if the transaction included a conversation with the Artist, including an electronic one.
• How to cancel: send a message to avi.cassouto@gmail.com, on WhatsApp or by phone at +972-50-5311748, with your full name, ID number and purchase date.
• The artwork must be returned in the condition in which it was received, in its original packaging. Return shipping is paid by the buyer, unless the cancellation is due to a defect, a mismatch or a delivery delay.

Cancellation Fee and Refund

If the cancellation is not due to a defect or a breach by the Artist, a cancellation fee of 5% of the price or ₪100, whichever is lower, will be charged. The balance is refunded by the same payment method within 14 days of receiving the cancellation notice.

Purchases at the Studio

A purchase made in person at the studio, after seeing the artwork, is not a distance sale and is final, unless agreed otherwise.

Commissioned Artworks

• Avi accepts commissions for custom works based on subject, size and color palette. The first consultation is free of charge.
• After the consultation you receive a written quote with the price, estimated timeline and deposit amount. Work begins once the quote is approved and the deposit is paid.
• Avi shares progress along the way and, when needed, presents a sketch for approval.
• The work is Avi's artistic interpretation. Once the sketch has been approved, a difference in personal taste is not grounds for cancellation. If the result differs substantially from what was agreed, we will find a solution together.

A work made specially to order cannot be cancelled under Section 14C(d) of the Consumer Protection Law. Cancelling before work has begun entitles you to a full refund of the deposit. Once work has begun, the deposit is non-refundable.

Workshops and Private Lessons

• Workshops are held in small groups at the studio in Jerusalem. Content, dates and price are provided in a personal conversation before registration.
• Registration is completed after a conversation and payment as agreed. A place in the group is held only once registration is confirmed.
• Cancelling a registration: within 14 days of registering, provided that you cancel at least two business days before the first session. A cancellation fee of 5% or ₪100, whichever is lower, applies.
• A missed session can be made up by arrangement, subject to availability. There is no refund for a session you did not attend.
• A private lesson can be cancelled or rescheduled up to 24 hours in advance. A later cancellation or no-show may be charged in full.
• If the Artist cancels a session or workshop, a new date will be set or the amount paid for it will be refunded.

Safety at the Studio

The workshops mainly use oil paints and thinners. Please let Avi know in advance about any sensitivity or allergy to materials. We recommend wearing work clothes, as paint stains may not wash out.

Copyright in the Artworks

Buying an artwork transfers ownership of the physical work only. The copyright and moral rights in the work remain with Avi Cassouto, in accordance with the Copyright Law, 5768-2007.

You May

• Display the artwork at home, in an office or in an exhibition, crediting the Artist.
• Photograph the artwork for personal use and share it on social media, crediting Avi Cassouto.

Not Permitted Without Prior Written Consent

• Printing, reproducing or making copies of the artwork, in any size or medium.
• Using the artwork or an image of it for commercial purposes, such as advertising, products or merchandise.

Liability

To the extent permitted by law, the Artist's liability is limited to the amount actually paid for the artwork, commission or workshop. The Artist will not be liable for indirect or consequential damage.

Changes to These Terms

The Artist may update these terms from time to time. Each transaction is governed by the version in force when it was made. The updated version is published on this page, and the date at the top is updated accordingly.

Governing Law and Jurisdiction

These terms are governed solely by the laws of the State of Israel. The competent courts of the Jerusalem District have exclusive jurisdiction, unless the law gives you the right to file a claim elsewhere.
